Terms of Use

Charades is a party game for iPhone made by an independent developer ("we", "us"). These terms are the agreement between you and us for using the app and this website. Installing or playing the game means you accept them. If you do not, please do not install the game.

Your licence

The app is licensed to you, not sold. We give you a personal, non-exclusive, non-transferable, revocable licence to install and play Charades on Apple devices you own or control, as permitted by the App Store Terms of Service and the usage rules in them.

You may not:

• copy, sell, rent, sublicense or redistribute the app or its content, including the card lists;
• reverse engineer, decompile or modify the app, except where that right cannot be excluded by law;
• tamper with purchases or the premium unlock, or use tools that do;
• use our name, artwork, card text or other content in your own product or marketing without written permission;
• use the app in a way that breaks the law or infringes someone else's rights.

You may of course film, stream and post your own games, guesses and terrible mimes included.

Purchases

Charades is free to download, and three decks are free to play. The other decks are unlocked by Premium, which you can get in two ways:

• Yearly subscription. It starts with a 3-day free trial where you are eligible. Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends. The subscription renews automatically each year unless it is canceled at least 24 hours before the end of the current period, and the renewal is charged within the 24 hours before that period ends. You can manage or cancel it in your iPhone's Settings, under your name › Subscriptions. If you cancel, Premium stays unlocked until the end of the period you have already paid for. Any unused part of a free trial ends when you buy a subscription.
• Lifetime. A one-time purchase that unlocks Premium with no renewal.

• Apple handles billing. Every purchase is made through your Apple Account under Apple's terms. We never see your payment details.
• What you get. Premium unlocks content inside the app for the Apple Account that bought it. It is a licence to use that content, not ownership of it, and it has no cash value and cannot be transferred or exchanged.
• Restoring. Reinstalling the app or moving to a new iPhone keeps your purchase. Use Restore Purchases in the app's settings while signed in with the Apple Account you bought with.
• Refunds. Refunds are handled by Apple at reportaproblem.apple.com. We cannot issue them ourselves. Where your local consumer law gives you a right of withdrawal or a statutory refund right, that right still applies.
• Prices. Prices are set per App Store region and shown in the app before you buy. They may change; a change never affects a purchase you have already made, and for the subscription Apple tells you before a new price applies to you.

Play safely

Charades gets people moving, shouting and waving their arms. Play in a space with room to move, keep a good grip on your phone, and never play while driving or doing anything else that needs your attention. Younger players should play with an adult around, and an adult should decide about purchases. You are responsible for how and where you play.

The cards

Cards name films, places, foods, holidays, sports, jobs and everyday things so that people can act them out. Titles, brands and other names that appear on cards belong to their owners. Charades is not affiliated with, sponsored by or endorsed by any of them. Cards are written for fun, are not advice of any kind, and are meant to be suitable for family play; if one is not, tell us and we will look at it.

Your progress and your data

Your settings, team names and which cards you have seen are saved on your device, not on our servers. We do not back them up and cannot restore them. Deleting the app deletes them. Your premium unlock is tied to your Apple Account and to an anonymous ID, so it can be restored as described above.

Changes to the game

We may add, change, rebalance or remove decks, cards and features, and we may stop supporting older versions of iOS. We may also stop offering the game altogether. If we do, content you unlocked may stop working once the app can no longer run or is removed from the App Store. We will not do this lightly, and nothing here limits refund rights your consumer law gives you.

Our content

The app, its card lists, artwork, name and this website belong to us and are protected by copyright and other rights. The Fredoka typeface is used under the SIL Open Font License, and the deck cover photos are public-domain (CC0) images. Feedback and card ideas you send us may be used without obligation or payment, and you confirm you have the right to send them.

Apple's role

This agreement is between you and us only, not with Apple. Apple is not responsible for the app or its content. The following applies to the version of Charades you download from the App Store:

• We, not Apple, are solely responsible for the app and for any maintenance and support. Apple has no obligation to provide either.
• If the app fails to conform to any applicable warranty, you may tell Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for any claim that the app or your use of it fails to meet a legal or regulatory requirement, arises under consumer protection or privacy law, or infringes a third party's intellectual property rights.
• You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the app, including the App Store Terms of Service.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

No warranty

The app and this website are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose and uninterrupted or error-free operation. We do not promise that the game is free of bugs, that every tilt will register, or that purchases can always be checked when a service is down. Some jurisdictions do not allow these exclusions, in which case they do not apply to you.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential loss, lost data, lost progress or lost profits arising from your use of the app or this website, or for injury or damage caused by playing carelessly.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded by law. If you are a consumer, your statutory rights are not affected.

Ending this agreement

You can end it at any time by deleting the app and, if you subscribed, canceling the subscription. We may suspend or end your licence if you materially break these terms, for example by tampering with purchases. The sections on our content, no warranty, limitation of liability and governing law survive the end of this agreement.

Governing law

These terms are governed by the laws of the Republic of Türkiye. If you are a consumer resident elsewhere, you keep the protection of the mandatory consumer law of your country of residence.

Changes to these terms

We may update these terms when the app changes or the law requires it. The date at the top shows the current version, and material changes will also be mentioned in the App Store release notes. Continuing to use the app after a change means you accept the updated terms.
